Virginia Personal Injury Laws

A Virginia law, known as the statute of limitations, gives injury victims two years from the date of the incident to file a personal injury claim against the party at fault in most cases. If a lawsuit is not filed within the set time period, victims may lose their right to sue the responsible party. When a lawsuit is being filed against a Virginian government entity, a written notice of the claim must be given to the government. A claim involving a city or town allows victims six months from the date of the accident to send notice. Whereas, a period of one year is given when a claim is against the Virginia state government or transportation district.
